For any parent going through family breakdown or divorce, the presence of a support network is vital, and this should include your employer.
Family breakdown contributes to stress, unhappiness and financial pressures which are compounded by protracted and adversarial court processes, which impact your ability to function at work.
A study by Resolution found only 10% of employees thought their employers did enough to support them during family breakdown. When the overall cost to the UK economy from family breakdown is around £48 billion, then we all have a part to play in supporting those affected by this.
The Nashville Business Journal reported that in the 6 months leading to and in the year of divorce, the affected employee’s productivity is reduced by 40% and their productivity can suffer for 7 years.

So how can you as a business or organisation help your staff members during this time? We understand that the last thing an employer wants is to become caught up in the court process, but it is clear from mental health studies that employers need to respond.
We can work with businesses, to help explore and develop a range of internal policies to benefit both the business and organisation, and their member of staff. All companies and organisations should have a Family Breakdown Policy.
We can help you identify support available and signposting to external organisations. Many firms already a variety of wellness initiatives and we recommend this includes specific advice on how to approach family breakdown and the court process well, and how to co-parent safely and appropriately after separation.
Men, in particular, are reluctant to openly discuss the challenges they face as a result of separation, contact issues and financial pressures, but we know they are at a higher risk of alcohol and drug complications when faced with these concerns, and more so suicide, so we need to work together to find preventative measures, in a way that does not make them feel compromised or a liability to their employer.

CASE MANAGEMENT
Not everyone can afford a Solicitor and Legal Aid is becoming more difficult to get, the inequality or arms in family court is fast becoming the biggest hurdle to fair and proportionate proceedings and outcomes.
There is an alternative.
If you choose to self-represent, then you can work with a McKenzie Friend, who for the fraction of the cost of a Solicitor, will provide a range of services from assisting to drafting applications and statements, to attending Court with you and helping with paperwork and note taking.

FAMILY COURT AWARENESS TRAINING (PARENTS)
In late 2024 we will be launching our Family Court Awareness Training for Parents. This will be available on line and in person and will be customised to your specific country and courts jurisdiction.
The half-day course will provide a thorough introduction to the family court process designed to help you navigate the main principles of court procedure, whether that is as a self-represented litigant / litigant in person. For those who choose to work with a Solicitor or McKenzie Friend, this course will give you a better understanding of the advice you are being given, so you can make informed choices for you and your children.
Information is always power in these situations, so this course is specifically designed to identify the key stages from application to Final Hearing, the different options that can arise at each hearing and who the key people are and their roles.
Each attendee goes away with an information pack, including statement templates and sample letters, designed to help you deal with the practicalities of the process and provide a better understanding moving forward.

MCKENZIE FRIEND TRAINING
Many people who offer a McKenzie Friend service come to the role because of their own experiences and they have a good understanding of procedure to help you navigate yours.
But finding a McKenzie Friend can be hard, as there are simply not enough people providing this service and one of the reasons for this is a lack of understanding of the role and training.
We aim to change that by promoting this affordable alternative to a solicitor, and by training people in this role .
Today McKenzie Friends can assist in many more ways than just note taking in Court, but getting to that point takes time and experience. If you would like to assist parent’s in family court proceedings, whether it is note taking, or offering a wider range of services, then our McKenzie Friend Course is for you.
This course guides you through the court processes and how to help your client prepare their case, taking you from application to final hearing, through court structures and key personnel, the drafting of applications and statements, understanding and advising on court reports, to how to support your client and how you should present yourself in court.
All attendees get an information pack, sample applications, statement templates and reports and a follow up session to guide you through your first case.
